As part of the settlement, Mashinsky is required to pay a $10 million fine. A ruling by Judge Denise Cote of the Southern District of New York indicates that the FTC's $4.72 billion restitution order against Mashinsky is largely suspended. However, this suspension could be lifted if Mashinsky fails to disclose significant assets, misrepresents asset values, or omits crucial information in his financial disclosures, at which point the full judgment would become due immediately.
